Archivist Terms of Service

1. Agreement to Terms

By using or adding the Archivist Bot (referred to as the "Bot") to your Discord server, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Bot.

2. Definitions

• Discord: The platform provided by Discord Inc. for online communication and community management.
• User: Any individual with a Discord account who uses the Bot.
• Server: A group or "Guild" on Discord.
• Server Member: A User who is part of a Server where the Bot is added.
• Server Manager: A Server Member with permissions to add or configure the Bot on a Server.
• Bot: The automated user on Discord, identified by the "BOT" tag, that provides the logging and other functionalities described herein.
• Associated Service: External services provided to enhance the Bot's functionality.

3. Bot Usage

3.1 General Use

The Bot may be used on any Discord Server. By joining a Server or by having the Bot in a Server, all Server Members, including those in mutual servers with the Bot, automatically consent to these Terms and the Privacy Policy.

3.2 Server Manager Responsibilities

Server Managers are responsible for communicating these Terms and the Privacy Policy to all current and future Server Members, and for managing the configuration and operation of the Bot in compliance with applicable laws and these Terms.

3.3 Logging of Messages

The Bot is designed to log messages in the server for which it is configured. By using the Bot, all Server Members, including those in mutual servers with the Bot, consent to the logging of messages within the Server.

3.4 Data Storage and Retention

All logged data is stored as outlined in our Privacy Policy. Message logs are retained for a limited period (as specified in the Privacy Policy) and are deleted after this period unless legally required to retain them longer.

4. Data Collection and Use

Data collected by the Bot is governed by the Privacy Policy. By using the Bot, you acknowledge and agree to the collection and use of data as described in the Privacy Policy.

5. Prohibited Activities

When using the Bot, you agree not to:

• Use the Bot for illegal or unauthorized purposes.
• Modify, adapt, or hack the Bot or falsely imply any association with the Bot or its services.
• Use the Bot to violate any applicable laws or regulations.
• Harvest, collect, or use any personal information about users without their consent.

6. Service Modifications and Termination

We reserve the right to modify, suspend, or discontinue the Bot or any of its services at any time, with or without notice. We may also limit the use of the Bot, and in some cases, suspend or terminate accounts of users who violate these Terms.

7. Disclaimer of Warranties

The Bot is provided "as is" and "as available," without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

8. Limitation of Liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your use of or inability to use the Bot;
• Any unauthorized access to or use of our servers and/or any personal information stored therein.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which the service is provided, without regard to its conflict of law principles.

10. Changes to Terms

We may modify these Terms at any time. If we make changes, we will provide notice by updating the "Last Updated" date above. Continued use of the Bot after any changes constitutes your acceptance of the new Terms.
